Terms of Service

1. Acceptance of Terms

Welcome to VibeSinger ("we," "our," or "us"). By accessing or using our website, mobile application, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years of age to access or use our Service. If you are under 18 years of age (or the age of legal majority where you live), you may use our Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. User Accounts

To access certain features of the Service, you may be required to register for an account (e.g., via Google Sign-In).

  • You are responsible for safeguarding your account credentials and maintaining the security of your account.
  • You agree to provide accurate, current, and complete information during registration.
  • You must immediately notify us of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

4. Ownership, Licensing, and Commercial Rights

VibeSinger utilizes third-party artificial intelligence engines to generate music, lyrics, and audio content. Because VibeSinger maintains the underlying commercial licenses with these providers, we process and sub-license rights to our users according to their subscription tier.

  • Free Tier Users: VibeSinger grants you a limited, non-exclusive, non-transferable license to use the generated output for lawful, internal, personal, and non-commercial purposes only. You may not monetize these tracks. Every public sharing or distribution of output generated on the free tier must include clear attribution to VibeSinger (e.g., "Generated via VibeSinger.app").
  • Paid Tier Users: During an active paid subscription, VibeSinger sub-licenses full commercial rights to you for the content you generate. You may upload, distribute, and monetize this content on platforms like YouTube, Spotify, Apple Music, and social media networks without mandatory attribution.
  • Free Tier Storage Limits: Songs generated by users on the free tier may be periodically deleted from our cloud servers after a certain period to manage storage capacity. Free users are strongly advised to regularly download and back up their generated songs. We are not liable for any loss of data on the free tier.
  • AI Copyright Disclaimer: Due to the nature of machine learning and Artificial Intelligence, VibeSinger makes no representations, or warranties that traditional copyright ownership will vest in any generated output. You assume all risks regarding the intellectual property status of the generated content.

5. User Conduct and Submissions

You retain all rights to the lyrics, text prompts, and audio files ("User Content") you submit to VibeSinger, provided you already own such rights. By submitting User Content, you grant VibeSinger a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the content to fulfill your service requests.

You agree you will NOT use the Service to:

  • Upload, post, or transmit any material that infringes upon the intellectual property rights, rights of privacy, or publicity of any third party.
  • Create "deepfakes" of real individuals, or generate unauthorized audio clones of celebrities, artists, or public figures without express written consent.
  • Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, or hateful.
  • Attempt to reverse engineer, decompile, hack, or interfere with the proper functioning of the Service.

6. Fees, Billing, and Subscriptions

Certain features of the Service are offered on a subscription basis. All payments are securely processed by our third-party payment partner (LemonSqueezy).

  • Billing Cycle: Subscription fees are billed on a recurring basis (monthly or annually) depending on your selection.
  • Cancellations: You may cancel your subscription at any time. Cancellations will take effect at the end of your current billing cycle. No prior pro-rated refunds are provided for partial months.
  • Price Changes: We reserve the right to change our subscription prices. We will provide advance notice of any price changes.

7. Copyright Warnings and DMCA

We respect the intellectual property of others. If you believe your copyrighted work has been copied or used on the Service in a way that constitutes copyright infringement, please contact us immediately. We will promptly remove infringing materials and reserve the right to terminate repeat offenders.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL VIBESINGER, ITS AFFILIATES, OFFICERS, DIRECTORS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless VibeSinger and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service; (b) a breach of these Terms; or (c) User Content posted on the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which VibeSinger operates, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in competent courts within that jurisdiction.

12. Changes to terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
